Kathleen L. Morgan has been practicing administrative law since 1992.  Since 2004, she has used her knowledge gained as an attorney for the State of California to provide honest and effective representation to licensees facing disciplinary proceedings.  She knows how complex and overwhelming the administrative process can be and will help you navigate the process and make informed decisions throughout the proceeding.  Kathleen represents clients in all stages, including, but not limited to, investigative interviews, administrative hearings, settlement proceedings, writs, and through the appellate process.

RECENT SUCCESSES IN ADMINISTRATIVE MATTERS

  • Board of Registered Nursing:  Obtained a result of dismissal of the accusation against my client when we showed through an expert witness that she did not violate the standards and practices of a registered nurse.

  • Department of Social Services:

    • Obtained dismissal of  accusation against family day care home licensee following an administrative hearing.  We successfully argued that the facts did not support cause for discipline.

    • In matter of multiple facilities, obtained dismissal of accusation against one facility and probation for remaining facilities after multiple day hearing. DSS had sought revocation on all facilities.  Agency refused to adopt and matter still pending final outcome.

  • State Personnel Board: Dismissal of Notice of Adverse Action after hearing which was upheld after reconsideration.

  • Writ of Administrative Mandamus in Solano Superior Court:  Obtained judgment for family day care home licensee, including $55,000 damages award and attorney's fees and costs. (Opposing party has appealed and the matter is currently pending before Court of Appeal)

  • Writ of Administrative Mandamus in San Francisco Superior Court:  Obtained judgment setting aside vicious dog hearing order

  • EMT: Obtained proposed decision following administrative hearing recommending dismissal of accusation due to no findings of fact to support cause for discipline.  Agency refused to adopt proposed decision and matter still pending final outcome.

  • State Personnel Board: Successfully challenged order upholding disciplinary action in Alameda Superior Court, which was upheld in the California Court of Appeal. (Case No.  A140865) Prevailed in remand hearing which resulted in all but one allegation being dismissed and discipline reduced to reprimand.

  • Obtained judgment of sole legal custody for father due to domestic violence perpetrated by mother following trial.

  • Obtained judgment of sole legal custody for father after trial due to myriad of issues.

  • Successfully negotiated division of family held business so both parties were able to continue to benefit.

  • Successfully negotiated division of real property in longterm marriage through tracing.

  • Obtained successfully ruling which allowed client to keep her home after post-judgment challenges.
